Bit of an accident !!!

Thankfully in the works van not my car,I was driving along this morning and came to a roundabout which i was going straight on,i almost got round it when a woman pulled out from the left straight in front of me,couldnt avoid her so i ran straight into the front o/s of her car (she came off worse than me !!). Fisrt of all she tried to say it was my fault because i wasnt indacating but i explained that how could i indacate when i was going straight on,then she tried to say it was my fault for not breaking when she pulled out in front of me !!!.
 
Indicating or not you were already on the roundabout, and emerging traffic must give way to traffic already on the roundabout. A freind of mine hit a car on a roundabout turning right, across his path, which was not indicating. The police said it was my freinds fault for the reason I have given.
 
This is what i thought as on a roundabout you have to give way to the right,i dont know how she didnt see me as i was about 3-4 away when see pulled out so i didnt really have much chance to break and when i did the wheels locked up anyway. i think she was just trying to shift the blame so she didnt have to pay for the damage . Im in the middle of filling the claim form out as we speak so i guess its upto theinsurance companys now !!!
 
Even if you were turning right and not indicating one of the first lessons I was taught when learing to drive was to not act on someones indicator - always wait until they start to turn before pulling out as they might have their indicator on without realising it. It has turned out to be a good piece of advice as i've lost count of how many times i've seen people driving down the road with their indicator on unknowingly.

Anyway - at least no one was hurt and it wasn't in your 944!!
 
I dont know what she was doing as i was that close that she must have seen me if she was looking,not too much damge to my van only a smashed headlamp and indacator,bent front panel and a bit of dirt missing off the bumper,the car didnt come off as well tho its going to need a bumper.wing,headlamp and looked to have pushed the front across. Funilly enough the exact same thing happened to the 944 in my avatar causing £2000 worth of damage not while i owned it tho !!!
 
Never mind the damage to the van, what about that whiplash you've developed, God that can be painful. Still, the compo does help with car parts, er, i mean the inconvenience.

Can't agree, or approve. That's dishonest, and puts premiums up for everyone.

Be very, very careful with injury claims. The insurance companies are both greedy and not stupid. They will do anything to avoid paying out if they can and will investigate all claims quite rigorously - and whiplash claims are usually 'started' by visits to a hospital and/or GP.

Also ensure that they do not operate their own knock-for-knock policies. That means that they only pay out to their insured and then both companies can increase their premiums. To avoid this, insisit that they act in your best interests - they have a duty to you as the insured.....

Good advice, unless your insurance company is the same as thiers, which happened to some one I know who when doing a 3 point turn (stationary at point of impact) and the insurance company did a knock for knock sketch on him. After 10 months of wrangling!
 
It was only a low speed impact so i wont be putting a claim in,As its a company van now i have filled the claim form in i will have no more too do with it thank god. Ive picked up the new parts to repair the van myself as we need the van back on the road asap. Wonder what hourly rate i should charge them !!!
 
As a good lawyer, I would suggest that you use a precedent; such as an OPC rate for a mechanic......

You will be very wealthy if you can get away with it [:)].
 
Would be nice if i could charge them,the deal is i fix the van rather than come into work next week,hopefully it should only take one morning to fix. I was surprised how cheap the parts were from a vw main dealer the headlamp only cost £75 ,i was expecting double that !!!
 
Just be careful to fill in all of the details on the claim - even go so far as to take pictures of the accident. Roundabouts are the biggest cause of knock for knock - no-matter if your in the right or wrong (and as wrong as that is!)

A couple of years ago my insurance settled knock for knock when some numpty crashed into me (while doing 30) and drove off. And that was despite me following him for 50 miles on the phone to 999. His excuse was that I crashed into him, and he didn't know that any damage had been caused. Luckily after complaining to my insurance company, and threatening legal action (through the legal protection I'd paid for!) the insurance company agreed to put it down as his fault (even though they still paid out half!). Nuts or what[:mad:]
