xenon headlight sensor mounting bracket

Am after a bit of advise - my xenon headlights have stoppped auto-adjusting and on closer inspection i have noticed that the bracket that holds the auto level sensor on the front suspension has snapped meaning it cant work. Firstly, has it set itself at a automatic legal level ? and if i replace the bracket and re-fit the sensor will it all work again or will it have to be reset by garage or opc ?
Also is it an MOT failure if they dont auto-adjust ?

You would know if it has gone into the 'safe' setting, as it only lights up the road a few feet in front of the car. I would just go ahead and change the bracket. It shouldn't need calibrating after fitting, as you will be putting it back to its proper position. As I understand it, it would only fail an MOT if the beams are set too high. They don't check the level control.
