Cayman woes

Hello all, I was just hoping to get some advice here about cancelling my Cayman order.

I ordered one and put my £5k deposit and spec'd the car and now due to a change in circumstance, I can't collect. I was told by my Porsche sales person that I could have my deposit back if I did not want it even up to the point that the car arrived.

But now, after my conversation with them, I've been told that the refund of the deposit is up to the discretion of management! Have I been shafted? can they not sell the car on to the next customer? Is this the standard practice?

I hope some one here can give me some advice about this and what I should do if they refuse the refund.

My OPC (Colchester) have told me on the last 2 Boxsters that I have ordered that unless I order a very unusual spec and colour that they would refund my deposit up to the day of collection. I have never had to test this but I have no reason to expect them recind on this arrangement while there is a waiting list. I was offered a queue jump opportunity when I was waiting for my 987 which I didn't take - it was certainly not offered with a £5k discount thanks to someone else' deposit going south.

While the terms may read "to the discretion of the management" you were given verbal agreement to the contrary - setting this out in writing to the dealer principal giving names and dates would be my first course of action.
 
I'm feeling very sick now at the thought of losing £5k for nothing. I really hope they will honour the verbal agreement and will wait and see what they come back to me with in the next couple of days.

Anyone want a Cayman at list due to be delivered in Jan?
 
Yes Jo, but Isn't yours an unusual (to sample?) colour?
I understand that is why it would be "non-refundable".

My OPC said that the worst case would be that if I cancelled the order months before build, they'd hang onto my deposit until the car was sold (either to someone on the list, or to a walk in when the car arrived at the showroom) at which point they'd return the deposit.

Don't just let them mug you for £5 grand.
 
That sounds a sensible solution Dapster.
I would use that as a "great idea" solution to present to them if they are awkward and don't refund straight away?

Of course they probebly read the Forum anyway...
 
Sorry to see that you have this problem.

Have a good long look at the contract you signed and see if it coincides with what was actually said to you.

If the OPC can sell the car wihout loss to itself then, IMO, they can have little complaint since they will have lost nothing [and gained interest over the months that they held your £5k].

Keep on at them or see a Solicitor if you have no joy. The expense of a lawyer will be nothing compared to your [potential] loss.
 
I think my deposit on a Cayenne was non refundable when finally specd.
I thought the Caymen was trading at £1000.00 premium can you not put an add in ST and sell it straight through?Worst case senario if it is not too highly specd.I will give you £4K under list for starters and i'm sure someone will pay you more on the Forum

Common practice at that particualr dealership. If you can't get a firm commitment to a full refund then speak to Porsche Cars Customer Relations it worked for a friend who recently had a similar problem with them. Good luck keep us all posted [&:]
 
thanks daro! i really hope it doesn't come to that. I was also having a brief chat with a friend in the legal industry and he said that they should return it (whether immediate or when the car is sold) to avoid the hassle as it will waste their resource to squabble over 5k for them.

of course the best thing is if someone buys the car off me :)

i will keep you guys posted.

PS: interesting remark about that particular OPC especially since they are the new flagship OPC for the UK
 
Well, I went down to the dealer today and now they say that they never say that "deposits are refundable". I spoke to their sales manager who told me that he will get a final word from his boss and get back to me this afternoon.

Just in case though, I was wondering if anyone else has been told that their deposit is refundable even up to the point of delivery if they should not want the car.

I hope someone can help me. Thanks in advance
 
Hi Mate,

I noticed your advert in Pistonheads, good idea. If Porsche say not refundable and you don't sell it privaty offer it to a car broker who may give you £2500 less, but then at least you've cut some of your losses.

why should you give Porsche £5000 for ordering a car they would sell in minutes[:mad:]

unbelievably, the OPC which I am dealing with seem to be avoiding my calls! I can't imagine a more unprofessional attitude, i mean, we're not children here, what's this about not returning calls and always in meetings! What kind of customer service is this?
