Help!! Do You Think Im Banned!!!!!

Hi all.

Realy P...d off - just received a letter throgh the post. Police with a camera on a bridge - clocked me doing 87mph on the motorway (70mph).

There is no mention of the 3 points and the fixed penalty on the letter if i admit it. Do you think its a ban then????

Cant sleep - Boxster would have to go up for sale!!! - I know they ahve the new points system in . Can anyone shed an light??? I was on the M60 Nr Manchester. Just because they ahve not offered me the points leads me to beleive i may be in more trouble. Do you think they would ban for 87 mph?( anyone with similar speed stories)

You only usually get a mandatory ban for over 100. (Speed limit +30mph). Depends on circumstances - i.e. weather conditions. Is the letter an Notice of Intention to Prosecute? If they're going to do you they have to post you one of these within 14 days of the offence. If not, its just a letter saying you're a naughty person and they'll get you next time.

Its NIP - they are going to prosecute, i would just take the 3 points now for 87mph , but there is no mention of that, my wife got caught on a Gatso in her compnay car a few months ago and they offered her the 3 points stright off , with this thye haven't , this is why i am a little bothered and i think it may be more points or even a ban.

It was a barmy hot day clear and dry , it was 11:30 in the morning , very little traffic. I had the roof up and the AC on as it was that hot. do you think they would get a clear pic in a boxster with the roof up?

you were travelling at 87 on the motorway, but have not been allowed the opportunity to be dealt with by way of fixed penalty notice....unusual.

you recieve the n.i.p. within the statutory 14 days, which means, you will recieve a summons for the matter to be dealt with at a magistrates court in the near future. but for the type of offence you have committed, i.e. speeding, you would normally, be allowed to plead by letter!!!!

are you sure you werent driving thru a temporary speed limit, if you were doing 87 in a 50, the magistrates will definitely want a word!!!!

it should say on the n.i.p., what the offence is, that you have allegedley committed.

I recieved one for 86 on the M4, empty three lane, dry sunny, late morning. Scam van hidden on second of 2 bridges over eastbound carriagway on right hand bend ( I was heading westbound). It also does not contain any points or fine info. I believe that once you return it identifying the driver (should you choose too) they will send out the conditional offer (but am not 100 % certain).

PS if they gave you any more than 4 points for 87mph I think some newspapers would be very interested.

Thanks for all your replies. No its not a wind up , its the real thing. It staes on the NIP that the offence is driving at 87 in a 70mph motorway.

I have a personal feeling that this is one for the magistrates, they ahve only sent me the original letter as yet - saying they intend to prosecute etc under RTA section etc. they have asked me to identofy the driver and send back within 28 days. GITS. hopefully when i send the details back , they will come back with a 3 points plus fine job, hopefully , i can stomach that, just dont want to go to court etc with increase in points and fine.

Im going to ask for the pic aswell , do you think this is wise? or will it get there back up.

Be aware - have been on the GMP police site and they are doing a blitz this month being JULY - so there will be alot of cameras on bridges etc running all the way through july.
 
I'm waiting for my letter to come through the door with much dread. Was being a bit over enthusiastic with the accelerator coming off the M4 to M32, sun ahead, so sunvisor down, hence the late spotting of the van with dreaded cameras. I've heard in the past of people getting off by questioning the callibration of the cameras, don't know if that is worth a shot??

In some areas, providing it is your first speeding offence you get offered the option of sitting a driver training course rather than getting the fine. I think you will get a follow up letter once you admit to driving the vehicle and get the statutory 3 points.
Even if you get called up to the beaks,I wouldn't worry too much about a ban anyway. From experience you get no additional points but you end up with an SP50 on your license.

Round here the driver training courses are only offered to drivers going up to 35 in a 30 - everyone else gets done. Someone who was driving my car a few years ago (wasn't me officer) was clocked at 84 in a 70 a couple of years ago and got 3 points plus £60 fine.
 
From my understanding the has been sent to identify the driver of the car. An offer to plead by post can only be made once the actual driver of the car is identified!

I wouldn't worry too much yet. Once you have admitted driving the car then the offence can be dealt with, either by post or through the magistrates court.

I was "done" 5 years ago 78MPH in 50MPH limit (Temporary motorway speed limit) on the M23 at Gatwick and pleaded by post. Subsequently earned 4 points on licence with fine
 
It is my understanding that, on motorway with a 70mph speed limit, the usual margin of discretion is 10% plus 5mph (ie 82mph).

Now many of us will routinely travel at an indicated 80-85mph. However, most Porsche speedos over-read. If you have a GPS speedo, you will find that an indicated 85mph (in a Boxster/996) is infact about 79-80mph.

So, a true 87mph, at the time of the offence, means that your speedo would have probably been reading c.93mph.
 
Sam dont worry about it. Just give up Helen Goff's name with her BAGHDAD address.I do and have never heard another word.
 
It's my understanding (and I could be wrong) that in this country you have the right NOT to incriminate yourself and/or your spouse. This is a whole in the system. If you send back the nip saying that you can't recall that day and that it may have been you or your wife driving they will then send her a nip. If she says the same thing then they will drop the case as they can't identify the driver. As I said I could be wrong on this but I seem to remember reading this somewhere.

Thanks for all Your replies. I have called the ticket office and have requested the phot shot of the car , i am going to ask for everything, make it as difficult for them as possible.

To be honest, they were quiet funny when i asked them for the pic, they were saying things like, ' why do you want that'?, ' you know it may not be clear' etc etc, ,

im going to get the pic and i will scan it onto the forum , so you guys can see the quality and the clarity of the police pics, im sending my details off anyway, juts lets make it a bit awkward. Hopefully it will only be 3 points.
 
The system sucks!

About 5 year ago my son got beat up prety bad by a gang of yobs outside a police station of all places (well this is Liverpool). Anyway, Plod calls me on the phone, said to come up to the station. By the time I got there he had
fallen unconcious and they rang an ambulance. He was just being loaded into the back as i arrived.
Plod said follow the ambulance and they would escort us to the hospital. I did that. Ambulance ahead, noddy car
behind me. We hovered between 50 and 70 MPH on the way there sirens ablaze. At one point we passed a gatso and I got flashed along with the crusade. Few weeks later i got the nip. Went to the police station spke to the officer who was involved.
Anyway.........we went to court. The result, the judge let me off the fine and just gave me 3 points. Police said
there was nothing they could do. Go figure!

BTW: my son is fine now.
 
Oliver -police guidelines are +10% + 2mph -I've stuck with that and never been pulled, except 107 on the Cirencester by-pass......and that WAS a ban, as is anything over 100mph.

87? Don't panic......
